how do you prove you are not common law even if you share a house with separate dwellings but you have a child?

we live together but independently of each other, no share bills or bank accounts. He has had a girlfriend for the past 10 years or so and I split from my boyfriend that lived here, revenue canada now deems us common law and has suspended certain tax benifits
