My mother is leasing an apartment that her sister owns. Her common law “husband” is not wanted in the house any more. He will not leave, and my mother has asked the law enforcment what she can do. They told her, “tough luck. he owns half of what you own.” I think thats bull! He is abusive, and worthless, and he isn’t wanted there, but he will not leave. Does any one know what my mom can do about this?

Oh yah, her sister, the owner, can evict him, but it will take over a month to do that. Is there any thing else she can do? Thank you so much ahead of time for your help!

I have a couple of rooms for rent in my house that shares a common area such as the kitchen and living room. Since the common area is a public ‘area’ am I allowed to install security camera there to monitor my house while I am away? (By the Canadian Law)

Also, if I do install one in the living room, I will be able to see a bit of the public washroom door. Is that okay?

He died leaving his house to his children specified in will. However, he married two years before he died to his common-law wife of 12 years. Now his kids want her out of the house she lived in for 12 years with their dad. Kids are mature and on their own. What rights does she have? So far she is still in the house and even an eviction notice sent to her by his kids’s lawyer failed to get her out. She hired her own lawyer and he said as his wife she has rights. That when the smoke clears, the house will be sold and divided between her and the kids.
Ever hear of this anywhere? Does she have rights even though the will states that the house goes to his grown kids?

What do I do if my common law marriage fails?

I reside in Texas. I have been living with this girl in her house for about 1 1/2 years. She has 3 kids from a previous marriage and now mine recently. Our relationship has not been good and we have had too many problems. She now says she wants me out of the house. I did help her pay her bills although there is no proof we lived together. We both have different last names and we keep it that way. Now what am I liable for besides my son?

My common law girlfriend and I have a house and have 5 kids one is 9, 11 ,12,12 and one 14.In the past 2 months she lost her job ( do to messing work and being late )and stays home now.She will not look for a job all she wants to do is stay home than look for a job.She watches TV, on the computer or read books and she is very lazy now.

She started smoking and drinking and this is happing every day in the house. How can I tell her to get a job and smoke and drink when the kids are gone to bad? I don’t what the kids to get interest in smoking or drinking if they see mom doing that every day.

Also she looks sloppy now .Her haire is a mess ,some times do not shower much and she got cheap new clothes that makes her look sloppy now.She used to look nice and cute but now into dressing sloppy .She got 3 new sweatpants , 3 new trackpants , 5 new jeans , 7 new night t-shirts that makes her look sloppy .Around the house or going out in pulic she looks sloppy now , her haire is a mess ,wearing sweatpants ,night t-shirts and flip flops .Or wearing t-shirts,shorts and flip flops.

Before she would get dress up and look nice and never had sweatpants ,trackpants or night t-shirts. She never dress sloppy in the house before or go out in public looking like this.I never seen her wear a t-shirt,shorts or barefeet around the house before or even out in pulic.We gone to store the other day and she was waring shorts ,flip flops and a night t-shirt.These t-shirt make her look sloppy has they are big on her and she never tucks in her t-shirts and should be for sleeping not around the house or going out in public like this.

How can I get her to put the clothes in the trash and get smart clothes and dreess up.This is having a effect on kids has they now starting to dress sloppy .

I’ll make this sweet and short. 2 people are common law, have 2 kids. Own a house where mortgage is being paid. The relationship isn’t working, therefore a mutual agreement to end it.

The guy makes less $$$ than the woman, good father, no previous history of being a bad person or father, ect. The female is making things worse by verbal threats, saying she’ll make sure he gets limited visitation rights ect.

1) She wants to get a lawyer, who has to pay the fee, him or her? (since she makes more she’s trying to make it costly, where he prefers not to pay lawyer fees, if she wants to go that route then pay it on her own).

2) He’s agreed to give her/kids the house and to take his name off the ownership. Should she not have to buy him out, he takes a loss to make things easier…what rights does he have? He could’ve just said NO were selling the house and splitting whatver they get, instead tells her to keep it.

3) I assume a lawyer present would ensure a legal agreement for visitation rights that both have to agree and abide by, however if he gives her the house how does this affect child support payments amount, especially if he makes less then her?

4) She’s a wackjob and deliberately is making things tough for him, whats his rights and what can he say or do to combat her antics?

***nothing against woman and common law, but things should be fair and unfortunately she’s making things difficult, the male is really innocent while the female is causing alot of B.S…no sympathy for her, its her loss but I want to hear what rights the guy has and what he can do when the tables are turned against him?
To “eman”, he definitely has rights….the problem is society and the justice system seems to always feel sorry for the female…its not about the female, its about fairness and the kids are explosed to her B.S which makes it worse.

As for the house…he could’ve said sell the house and split the profit. Yet he’s willing to take his name off the mortgage and give her the house…she should have to buy him out….OR at least this should be taken into consideration for child support.

As for visitation rights, she doesn’t dictate when he can visit his kids…its an agreement bound by legal documentation signed off by a lawyer, sure they both have to agree to terms but if she breaks those terms she hurts her own credibility and custody priveledges for not abiding by the conditions set.

Instead of getting opinions, can someone with legal background provide some insight on what his options are based on what I’ve indicated, and what rights he can use against her.

1) There common law, not married at all.
2) They have 2 kids together.
3) She makes more $$$ than him.
4) The house is in both names, she insists he HAS to take his name off so that the house is in her name and not both.

***I guess by doing this, she’ll be responsible for the mortgage payments…maybe a loss for him but doing this is to avoid anymore conflict with her. I assume if he doesn’t take his name off, then he could just say he wants her to buy him out or sell the property and split the profit…but I think it would just make matters worse, cause then she and the kids would have to find a place, its really his kids he cares about and therefore thats why he’s willing to let her have the house to avoid anymore headaches she’s causing.

It is in Ontario, Canada, but regardless where you live in the world, the judicial system is never fair, in this case woman abuse there rights.

my 4.5 years common law suddenly vanished. I used to live with him in his parent’s house. My common law was suppose to be on vacation for 2 weeks only but he hasnt come back and it has been 5 weeks. I was suppose to live with my parent for 2 weeks only and yesterday i got a call from my common law father that he has packed all my stuff and wanted to dropped it off my parent’s place.

My question is, can my common law father just legally go through my personal stuff and packed it? And just evicted me like that?
isnt it going through personal stuff without consent is illegal?
+ btw me and him are having a kid too and he hasnt give any money or anything.. for the kid, just abandoned. Any law against this?

for instance, if an owner says room includes full kitchen & house priveledges ( and owner doesnt even live there) and includes PG&E and cable, is he allowed to come inside whenever he feels he wants to & more importantly, is it legal to put a lock box on the air conditioning/ heating thermostat & make the tenants suffer without it??? Does anyone know of a website I can go to for further information? Thanks!
